What is gross misconduct?
Gross misconduct describes a situation in which an employee engages in poor behaviour which is so serious that it warrants dismissal without notice, even if it is only a first offence.
The term generally refers to behaviour which threatens:
- the wellbeing or safety of the employee or their colleagues
- the employer’s reputation
All employers should document the types of behaviour which may constitute gross misconduct to ensure that employees have a clear idea of what is expected of them.
Examples of gross misconduct
The following are examples of behaviour that could constitute gross misconduct in the workplace:
- Violence at work
- Sexual harassment
- Deliberate damage to company property
- Theft
- Fraud
- Substance abuse
